Public Comment Opportunity: Draft UPK/CCCAP Fund Stacking Rules

The Colorado Department of Early Childhood (CDEC) has released an initial draft of the UPK/CCCAP Fund ‘Stacking’ rules to guide providers serving children who are ‘dually’ enrolled in the Colorado Universal Preschool Program (UPK) and the Colorado Child Care Assistance Program (CCCAP). To ensure these proposed rules are responsive to community needs and free of unintended consequences, CDEC is inviting early public input. This public comment period is an opportunity for families, providers, community partners, and public members to shape how these funding streams are aligned to better support Colorado children, both for now and the future.

The goal of the proposed UPK/CCCAP Fund ‘Stacking’ rules are to align available early childhood funding streams in a way that supports equitable access to care, maximizes cost efficiency, and ensures compliance with state and federal regulations. Specifically, the rule proposes a “stacked” payment model, where UPK funds are applied first to cover the delivery of preschool services. CCCAP funds would then be used to cover wraparound care, such as early morning, late afternoon, and non-preschool hours. This coordinated strategy promotes continuity of care, simplifies provider reimbursement, and helps working families more easily access affordable full-day care.

These proposed rules will also include an update to the Federal Poverty Guidelines (FPG) used to determine a child’s eligibility for low-income or poverty-based prioritization to receive additional preschool hours. While the primary focus of this rulemaking is the implementation of a ‘stacked’ payment model for UPK and CCCAP, CDEC identified this as a timely opportunity to align the rules with the most current federal guidelines. By including the 2025 FPG figures now, we can ensure the data is embedded into the rules early on to support administrative efficiency and allow programs and families adequate time to prepare for the 2026–2027 school year without unnecessary disruption.

NEXT STEPS

After the public comment period closes:

  • CDEC will review and incorporate feedback into the draft rule.
  • The revised draft will be presented to the RAC County Subcommittee on July 3, 2025, and the Rules Advisory Council (RAC) on July 10, 2025.
  • The rule will be considered for Emergency adoption on July 24, 2025, and Permanent adoption on August 28, 2025.
