Request for Written Comments: Proposed changes to the Early Intervention Colorado Rules

The Colorado Department of Early Childhood proposes changes in two components of the Early Intervention Colorado Rules 8 CCR 1405-1:

  • Redetermining Eligibility: The Early Intervention (EI) program is adding requirements for redetermining children’s eligibility annually. This ensures resources serve children most in need and will result in approximately $1 million in annual cost savings [Rule 5.111 G or 5.115]. This strategy was supported by the majority of workgroup participants. The full report can be found here: December Request for Information (RFI).
  • Funding Hierarchy: The EI program is clarifying the funding hierarchy to remove parent cost participation, child welfare, and TANF as funding sources, and clarifying private insurance as plans that pay into the Early Intervention Services Trust [Rule 5.107].

WHAT THIS MEANS

  • 5.107 Coordinated System of Payment: Private pay by parents was removed because EI services must be provided at no cost. Child welfare/TANF were removed as they are not required sources. Rule clarifies private insurance as the Early Intervention Services Trust (EIST). Families are not responsible for co-pays.
  • 5.111 G / 5.115 Individualized Family Service Plan (IFSP): Every child will now have an annual evaluation to confirm eligibility (significant delay of 25% in two areas or 33% in one area). Children with established conditions remain eligible and will not be reevaluated annually.

COMMUNITY ENGAGEMENT OPPORTUNITIES

Please submit comments using the Public Comment for Early Intervention (EI) Colorado Rule Change regarding the draft EI Colorado Rules (Redline Draft | Clean Draft) by March 13, 2026.

NEXT STEPS

CDEC will review public feedback and incorporate recommendations into the draft EI Colorado Rule as able. Review by the Rules Advisory Council (RAC) is expected May 14, 2026, with emergency adoption considered May 28, 2026. Permanent adoption is considered June 25, 2026.
